Appeals Court Grants Expedited Review of Trump Campaign’s Pennsylvania Lawsuit By Jack Phillips

President Donald Trump’s campaign on Monday secured a legal win after the U.S. Third Circuit Court of Appeals granted an expedited review of their appeal from a Pennsylvania court, according to Trump campaign lawyer Jenna Ellis.

According to the order, Trump’s “motion for emergency expedited review is granted at the direction of the court.”

Their brief now needs to be filed by 4 p.m. on Monday, Nov. 23. “The court will advise if oral argument desired,” it said.

Pennsylvania’s 67 counties are scheduled to certify their election results by the end of Monday before sending them to state election officials.

Over the past weekend, Judge Matthew Brann dismissed the campaign’s lawsuit, which had sought to throw out hundreds of thousands of votes in Pennsylvania, saying that election officials in Philadelphia and other Democratic-leaning counties violated the equal protections clause under the U.S. Constitution. They alleged that those counties allowed voters to “cure” mail-in ballots that had issues, while GOP-leaning counties followed the law and didn’t alert voters about potential issues with ballots.

Brann, an appointee of former President Barack Obama, ruled Saturday that he “has no authority to take away the right to vote of even a single person, let alone millions of citizens.” The order allowed Pennsylvania to move forward with certifying the results of the Nov. 3 election. Current data shows that Democrat Joe Biden is ahead of Trump by around 80,000 votes in the Keystone State.

With a number of governors instituting new lockdowns this month, and doing their best to cancel Thanksgiving, it seems the backlash is coming, if it’s not already here. A country that’s about to observe a holiday in which we express appreciation for our unique American blessings appears ready to shrug off the chains of petty tyrants. For that, we give thanks.

Governors in, most infamously, California, New York, Oregon, and Minnesota, but also other states, have told constituents to limit their celebrations and travel. They might not in every case have specifically cited Thanksgiving. But it’s obvious that the nagging has accelerated because of the holiday. It’s just as obvious that, after more than eight months of various lockdowns, some Americans have had enough.

In an unmistakable rebuke to Andrew Cuomo, sheriffs in New York have said they won’t be enforcing the governor’s 10-person limit at private gatherings. Saratoga County Sheriff Michael Zurlo, for instance, said he didn’t “see how devoting our resources to counting cars in citizens’ driveways or investigating how much turkey and dressing they’ve purchased is for the public good.” Erie County Sheriff Tim Howard has promised he will do what the busybody governor refuses to do and that is “respect the sanctity of your home.”

While many Democrats and their allies in the traditional media argue there is no evidence of systemic voting irregularities in the Nov. 3 election, a mountain of evidence has been amassed in private lawsuits alleging there was, in fact, significant and widespread voting misconduct.

The question for the courts is whether the irregularities were widespread enough to impact the outcome or erase Joe Biden’s lead in at least three of the six battleground states where results are being contested.

Michigan State Attorney General Dana Nessel has attributes of a Nazi.  She, like Washington Post columnist Randall D. Eliason, wants to falsely prosecute attorneys who represent those making challenges to the election. She also wants to prosecute election officials who refuse to certify until irregularities are properly dealt with, and she wants to prosecute Pennsylvania Republican state officials who met with Trump at the White House. In other words, Dana Nessel has proved herself unfit for any public office by her effort to weaponize law for her political agenda.

Matthew Brann, a federal district judge appointed by Obama, refused to accept Giuliani’s lawsuit against the Pennsylvania election fraud.  The judge was not content to deny the case a hearing.  He used the occasion for a propaganda attack, demonizing the lawsuit, based on affidavits from witnesses who signed under penalty of perjury, as “speculative accusations unsupported by evidence.”  The judge knows full well that affidavits are always evidence.  So we now have an Obama federal judge who for political purpose pretends to be thoroughly ignorant of law and not know that affidavits signed under penalty of perjury are always evidence.

In all the excitement among objective journalists for Joe Biden’s declared victory, reporters are missing how extraordinary the Democrat’s performance was in the 2020 election. It’s not just that the former vice president is on track to become the oldest president in American history, it’s what he managed to accomplish at the polls this year.

Candidate Joe Biden was so effective at animating voters in 2020 that he received a record number of votes, more than 15 million more than Barack Obama received in his re-election of 2012. Amazingly, he managed to secure victory while also losing in almost every bellwether county across the country. No presidential candidate has been capable of such electoral jujitsu until now.

While Biden underperformed Hillary Clinton’s 2016 totals in every urban county in the United States, he outperformed her in the metropolitan areas of Georgia, Michigan, Wisconsin, and Pennsylvania. Even more surprising, the former VP put up a record haul of votes, despite Democrats’ general failures in local House and state legislative seats across the nation.

He accomplished all this after receiving a record low share of the primary vote compared to his Republican opponent heading into the general election.

The election-related litigation launched by President Donald Trump’s campaign is not an attack on democracy but appropriately following processes outlined in the Constitution, Sen. Kevin Cramer (R-N.D.) said Sunday.

“These are processes that are in our Constitution, in our laws, and they’re not just appropriate, but they’re really an obligation, frankly, to the millions of Americans that President Trump is a reflection of. I know, you know, a lot of people like to think that we’re the reflection of him. He’s the reflection of millions of people that want to see him fight this to the end,” Cramer said during an appearance on NBC’s “Meet the Press.”

“I think everyone ought to calm down a little bit. I don’t see this as an attack on our democracy. I mean, we spent four years listening to news shows and liberals discrediting, trying to discredit the Trump administration to the point of spying on him by the last administration. Forty million dollars spent on an independent counsel that started with no evidence and ended proving that there was no evidence. And then, of course, this crazy impeachment. So, I think what we’re experiencing now, everyone ought to just relax and let it play out in the legal way. We’ll be just fine,” he added.

Media outlets and some lawmakers, primarily Democrats, have tried pressuring Trump into conceding to challenger Democratic presidential nominee Joe Biden, even as Trump’s campaign and others battle in court to contest results in key battleground states, asserting Trump actually won some states where Biden is ahead.

Trump’s campaign has alleged election fraud. Some of the lawsuits include affidavits from poll workers and observers attesting under the penalty of perjury to witnessed fraud.

By now it should be obvious – even to conservatives – that we are in a war. It is a conflict that began nearly fifty years ago when the street revolutionaries of the Sixties joined the Democrat Party. Their immediate goal was to help the Communist enemy win the war in Vietnam, but they stayed to expand their influence in the Democrat Party and create the radical force that confronts us today. The war that today’s Democrats are engaged in reflects the values and methods of those radicals. It is a war against us – against individual freedom, against America’s constitutional order, and against the capitalist engine of our prosperity.

Democrat radicals know what they want and where they are going. As a result, they are tactically and organizationally years ahead of patriotic Americans who are only beginning to realize they are in a war. The Democrats’ plan to steal the 2020 election was hatched many years ago when Democrats launched their first attacks on Voter I.D.s, and then every effort to secure the integrity of the electoral system. Those attacks metastasized into an all-out assault on Election Day itself with early- and late-voting grace periods, and a flood of 92 million mail-in ballots, hundreds of thousands of which were delivered in the middle of the night to be counted behind the backs of Republican observers after Election Day had passed.

The result of these efforts is that Election Day no longer really exists as a day when the votes are cast and counted. This is a fact that offers generous opportunities for the election saboteurs to do their work. Those saboteurs’ opportunities were greatly enhanced this year with the installation in battle ground states of voting machines specifically designed to calculate how many votes were required to steal an election and then to switch ballots already cast and deliver them to the chosen party. Mail-in ballots were indispensable to the realization of this plan.

American cities are entering a period of chaos. Protests and riots have dominated headlines, but beneath the surface, activists are launching an unprecedented campaign to overthrow the traditional justice system and replace it with a new model based on a radical conception of social justice.

In Seattle, where this campaign may be most advanced, activists have crafted a narrative about police brutality, mass incarceration, and punitive justice that leads to a natural sequence of solutions: “abolish the police,” “divest from prisons,” and “defund the courts.” Over the past three decades, the city’s radical-progressives have seized control of municipal government—with the notable exception of the criminal-justice system, which they see as the final obstacle to total control. If they can dismantle it, activists believe, they can bring about their transformation of society.

The city’s political establishment has joined the campaign to “deconstruct justice.” Since the outbreak of the George Floyd–related protests starting in late May, elected officials in Seattle and King County have announced their intentions to defund the Seattle Police Department, permanently close the county’s largest jail, and gut the municipal court system. They believe that, when the oppression of the justice system is lifted, a new society can be shaped through criminal diversion, psychotherapy, and harm reduction.

The theoretical underpinnings of this movement can be traced back to the academic currents of “critical race theory,” long pervasive in university humanities departments, which holds that all legal structures—and society generally—can be understood as a function of embedded racism. The law is shot through with white supremacy, critical race theorists believe, which must be rigorously identified and dismantled if true justice is to be achieved. In recent years, critical race theory has expanded beyond the academy and become a force in progressive politics.
