Obama recently decided to effectively suspend enforcement of immigration law and unilaterally legalize huge numbers of illegal aliens. But one of his minions is sending around letters threatening states who refuse to accept his army of Syrian migrants, at least 13% of which poll as supporting ISIS. That means out of his first 10,000 Syrians, over a thousand would be ISIS supporters.

States are required to provide “assistance and services … to refugees without regard to race, religion, nationality, sex or political position” according to the Refugee Act of 1980, the letter points out.

“States may not deny ORR-funded benefits and services to refugees based on a refugee’s country of origin or religious affiliation,” the letter states. “Accordingly, states may not deny ORR-funded benefits and services to Syrian refugees.” States that do not comply with these terms are subject to “enforcement action, including suspension or termination.”

According to Title VI of the Civil Rights Act of 1964, discrimination based on race or origin is against the law in all programs that receive federally-funded assistance, the letter adds.

Of course immigration policy precisely discriminates against immigrants based on their country of origin or religious affiliation, since the latter is used to determine quotas, while the former is used to verify claims of religious persecution.

Obama is claiming that the Civil Rights Act applies to immigration policy at the State level, but not the Federal level.

This is a new level of lawlessness even for Obama.

The “political position” part is especially wonderful. If we took it literally, we wouldn’t be able to keep out Nazis, Communists and assorted other people with a political viewpoint we don’t like. How can we keep out a nice fellow who politically supports ISIS for that matter, as long as he doesn’t take any action to aid ISIS?

That’s what Obama is insisting. And that’s not even policy at the Federal level.

While “suspension or termination” sounds scary. Especially coming from an illegal regime operating without regard for the law, what it means is that funding to states for resettlement programs would be cut.

Since states are opting out anyway, they might as well opt out all the way.

Furthermore Obama is already in violation of the Refugee Act (what else is new) by failing to provide timely notification and information to states about incoming refugees. Obama even refused to provide that information to local law enforcement.

The Refugee Act also contains straightforward grounds for sending the fake Sunni Muslim refugees Obama is taking, instead of the real Christian and Yazidi refugees, back where they came from.

“The Attorney General shall not deport or return any alien Deportation. (other than an alien described in section 241(aX19)) to a country if the 8 use I25i. Attorney General determines that such alien’s life or freedom would be threatened in such country on account of race, religion, nationality, membership in a particular social group, or political opinion. “(2) Paragraph (1) shall not apply to einy alien if the Attorney General determines that— “(A) the alien ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; “(B) the alien, having been convicted by a final judgment of a particularly serious crime, constitutes a danger to the community of the United States; “(C) there are serious reasons for considering that the alien has committed a serious nonpolitical crime outside the United States prior to the arrival of the alien in the United States; or “(D) there are reasonable grounds for regarding the alien as a danger to the security of the United States.”
