MY SAY: GERALD WALPIN ON MIRANDA….THE SUPREME COURT INVENTION OF A RIGHT TO LET THE GUILTY GO FREE

How many times have we seen a movie or a column on a criminal being told his “Miranda rights?” Have you wondered as I have, why violent criminals have these rights which exclude confessions from admissible evidence?

In his book “The Supreme Court vs. The Constitution” Gerald Walpin reminds us “…the primary function of government…is to render security to its subjects. And any mischief menacing that security demands a remedy commensurate with the evil.”

In fact “Until the Miranda decision, when five justices, outvoted four colleagues, the Supreme Court many times reiterated that a confession obtained while the defendant was in custody was admissible, without any specific required procedures, as long as evidence showed that it was freely given and not induced by fear or threats.”

Twenty years after the Miranda ruling, in 1985, Justice Sandra Day O’Connor voices views that contradicted the reasoning behind the Mirnada rule. “The failure of police to administer Miranda warnings does not mean that the statements received have actually been coerced’ and”when the admission is not coerced, little justification exists for permitting the highly probative evidence of a voluntary confession to be irretrievable lost to the fact finder.”

ANDREW McCARTHY: JOHN McCAIN FAILS TO DISTINGUISH BETWEEN ALLIES AND ENEMIES

Did you catch Senator John McCain’s much-heralded (by Senator McCain) trip to the Syrian civil war — by way of our NATO ally Turkey, the lifeline of the Hamas terrorist organization? Yeah, Senator McCain blew into town to prove that all of us dissenters from his latest adventure in “Democracy, Sharia Style” are wacko birds. Surely, the Forward March of Freedom can work just as well in Damascus as it has in Benghazi, Cairo, Baghdad, and Kabul.

Well, he’s probably right about that.

The Maverick is sensitive to the criticism that he has been a smidge less than discriminating when it comes to sorting out America’s friends from America’s mortal enemies. Thus, the immediate objective of his latest Middle Eastern jaunt was to show that the anti-Assad “rebels” — I’d call them the Syrian Mujahideen, which is how most of them think of themselves — are predominantly, indeed overwhelmingly, secular and moderate. Oh, there may be a bad apple or two in the rebel legions, but rest assured that the arsenal McCain wants to dole out to them, in conjunction with U.S.-led aerial attacks on Assad’s forces, will not be yet another exercise in arming the next anti-American jihad. Those who claim we cannot tell the good guys from the bad guys are just a bunch of craven isolationists.

How unfortunate for the senator, then, that he managed, in the midst of this scintillating exhibition, to get himself photographed with Mohamed Nour and Ammar al-Dadikhi (also known as “Abu Ibrahim”) — two of the swell “rebels” from the very moderate “Northern Storm Brigade” who last year kidnapped eleven Lebanese Shiite pilgrims. Nour is the chief spokesman for the Brigade, which is still holding nine of the pilgrims captive.
Oops.

True to form, McCain completely missed the point of his contretemps. His office quickly issued a statement asserting that “it would be ludicrous to suggest that the Senator in any way condones the kidnapping of Lebanese Shia pilgrims.” Well, yes, that’s probably why no one is suggesting it (as Allahpundit explains in an excellent analysis at Hot Air). No one thinks the Beltway’s progressive Islamophilic consensus affirmatively endorses the jihad. McCain & Co. are just willfully blind to the fact that it thrives on their delusions.

THE LOIS LERNER DEFENSE: MARK STEYN

We have the president of the United States’ word as a gentleman that he knew nothing about the Internal Revenue Service’s targeting of his enemies until he “learned about it from the same news reports that I think most people learned about this.”

Furthermore, although the commissioner of the IRS, Douglas Shulman, visited Obama’s White House no fewer than 157 times, which is 156 times more than his predecessor Mark Everson ever visited the White House, we know that this was for legitimate Easter-egg rolls, as he testified to Congress, and meetings to discuss Obamacare. The Easter Bunny, one should note, visits the White House two to four times as often as the average IRS commissioner did before Mr. Shulman came along. But you can’t make a health-care omelet without breaking Easter eggs: It is one of the many distinctive features of Obama-style “health” “care” “reform” that, while it has not led to the hiring of a single additional doctor, nurse, or hospital janitor, it did require the biggest expansion of the IRS since the Second World War. So, when he wasn’t rolling Easter eggs and advising the moppets on whether they needed to declare the luxury Belgian white chocolate balls with praline filling, he was participating in vital meetings on how many extra SWAT teams he was going to need to enforce the new colonoscopy non-compliance penalty.
Let us also overlook the excellent treatment received from the IRS by members of the president’s family. Although acting commissioner Steven Miller apologized for the “horrible customer service” conservative taxpayers had gotten, a gentleman by the name of Malik Obama received impeccable, express service when he took the precaution of mailing in his non-profit application from N’giya, Kenya, rather than notoriously slower mail processing centers such as Phoenix and Dallas. Malik, the brother of President Obama, runs the Barack H. Obama Foundation, named for the president’s father. On May 30, 2011, they applied for tax-exempt status, and had their approval signed less than a month later by Lois Lerner herself, and conveniently backdated by Lois to cover the two-and-a-half years the enterprising Malik had already been raking in “tax-deductible” donations from Americans. The Washington address of the Barack H. Obama Foundation appears to be bogus, and it’s not clear whether the funds are being used back in Kenya for anything other than supporting the famously lavish lifestyle of Malik and his twelve wives. Given that the IRS is not shy about asking American conservatives for Facebook posts and lists of who attends their meetings, Ms. Lerner surely would have been within her rights to ask Malik Obama about the “exclusive” photographs currently displayed on the Barack H. Obama Foundation website of a recent meeting in Sudan, one of only four countries the U.S. government designates as a “terrorist state,” and the Foundation’s apparently extensive association with the Sudanese president and blood-soaked genocidal war criminal Omar al-Bashir. Given that the IRS likes to ask conservative taxpayers whether their friends and relatives are planning on running for office, Ms. Lerner might like to ask Malik Obama when his friend President Bashir is planning on leaving office. After another quarter million corpses?

A PINCH OF SALT

There are reports that Mayor Bloomberg received letters that tested positive for Ricin. I’m sure his butler and his butler’s butler and his butler’s butler’s assistant are all very worried about their health.

Not Bloomberg though who is immune to Ricin, the Ebola virus, cholera, nerve gas, u-238, foxglove, typhoid fever and a plague of rabid bats.

Sending Bloomberg barrels of Ricin is absolutely useless. But farmers out on Staten Island say that putting a pinch of salt in front of their doorsteps will keep him away for a week. The salt has to be replaced every time it rains and they say that sea salt works best. Bloomberg hasn’t shown his face there in a while so the salt is probably doing its job.

Reports that Bloomberg can be kept away by wearing cloves of garlic are untrue. Bloomberg can stand exposure to garlic and sunlight. However anything with a lot of calories will send him fleeing into the night. If you walk down the street wearing a string of ketchup packets around your neck, no Bloomberg can harm you. If you light up a cigarette while doing it and swig from an open bottle of liquor, you can hear his thin keening cries of pain drifting up or down all the way from 77th Street.

If you find yourself being chased by Bloomberg late at night, instead of trying to run, bend down and erase a bicycle lane. Bloomberg will compulsively redraw it, leaving you free to enjoy your evening.

You can also distract Bloomberg by picking up a soda can and exclaiming, “I bet this is good for me.”

Is Obama no more than the American errand boy of the Jihadis and their sponsors?

All scandals have layers of meaning. Watergate was about a second-rate burglary, but more importantly, it was about Richard M. Nixon’s abuse of presidential power.

However, much of that message was ruined by the fact that Lyndon B. Johnson abused power as much as Nixon did. Because Nixon is still a convenient whipping boy for the left, we never hear about LBJ’s sins.

Twenty years before Watergate, Nixon was engaged in a brutal battle with the Stalinist left of the 1950s. Watergate “gave the left a sword,” as Nixon famously said. The Washington Post assaulted the Nixon presidency in collusion with Mark Felt (Deep Throat), who hated Nixon for passing him up for FBI director.

Watergate was therefore a major battle in the long war between the radical left and mainstream America.

Like Watergate, Benghazi has several layers. But the most revealing one is the active collusion between this administration and Al Qaida.

Al Qaida is a Saudi-inspired and Saudi-funded terror gang. Almost all of the terrorists on 9/11 were Saudis. Those facts are always covered up, but they are crucial to understanding the Jihad War.

In Benghazi we ran arms from Libya to Al Qaida rebels in Syria. The Saudis are funding that rebellion.
