The June 5 voter recall of Judge Aaron Persky once again brings the Brock Turner 2015 rape case fiasco into the news. Turner, a student-athlete at Stanford, was prosecuted and sentenced for sexually assaulting a young woman at a drunken frat party. The particulars of the case were ambiguous from the start. Both participants in the sexual encounter were heavily intoxicated, and the woman claimed not to remember what had happened. No one saw the two leave the fraternity house. Turner was fully clothed when he was spotted lying on, and presumably molesting, the woman, AKA “Emily Doe,” by two passing Swedish bicyclists in the early hours of the morning – not an especially good time, given the hour and a nocturnal peloton, for accurate observation.

Many other elements of the case were equally problematic: the woman was already in a state of partial inebriation when she was driven – irresponsibly, in my opinion – by her mother to the party; she chatted to her boyfriend on her cell phone just prior to leaving with Turner on their midnight rendezvous, indicating that she was still more or less compos; the police report swarmed with lurid assumptions that could not be proven or were merely inferential; and much more, detailed both in my previous article and my wife Janice Fiamengo’s video on the subject.

Anyone interested in the truth should examine the court documents, all 471 pages, replete with inconsistencies, unverifiable interpretation, bias, conjecture, and twisted logic, before rendering judgment. Here is where the crux of the issue resides, not in the stanchless profusion of articles, blogs, reports, tweets, and Facebook postings that minister to unfounded righteous indignation and accusations of rape or assault. The lede in The Independent, to take just one example among many, already assumed Turner’s guilt and the judge’s complicity, calling the sentence “lenient” and Turner a “rapist” – the first a matter of opinion and the latter provably false.

Liberals put out yard signs that say “Hate Has No Home Here,” yet these are some of the very same phonies who are practicing hate and discrimination themselves on a regular basis.

Talk about hypocrisy.

Take the Red Hen in Lexington, Va. On Friday, Trump press secretary Sarah Huckabee Sanders — an educated, professional working mom — went to the restaurant but was booted by its liberal owner for simply working for the Trump administration.

How is this type of hate and blatant discrimination any different from a pre-Civil Rights Act restaurant in rural America refusing service to black patrons? Or if a modern-day restaurant were to refuse to serve an openly gay couple?

It’s not. Discrimination is discrimination, whether that’s refusing service for one’s skin color, religion, sexual orientation, marital status or political affiliation.

It’s also an assault on the core pillars of a democracy. A political system that supports a plurality of political parties voters can choose from. One that distinguishes America from one-party dictatorships under Communist regimes.

Rep. Maxine Waters (D-Calif.) urged liberal protesters to harass members of the Trump administration, calling upon the name of God to encourage liberal activists that He is on “our side.”

“Already, you have members of this cabinet that are being booed out of restaurants, who have protesters taking up at their house,” Waters declared. She praised these protesters for chanting, “No peace! No sleep!”

The congresswoman went on to attack Attorney General Jeff Sessions for quoting the Bible to defend enforcing immigration law. “While you try and quote the Bible, Jeff Sessions, and others, you really don’t know the Bible,” Waters declared.

“God is on our side!”

She then went on to specifically advocate for continually harassing Trump administration officials, particularly members of the cabinet. CONTINUE AT SITE

As a poet and essayist, I have always been interested in the power of the phrase: the epithet, the slogan, the aphorism, the idiom, the cliché, the qualifier, the tag, the label, the title and the name. Of course, such locutions often carry neutral implications as mere designators, or may generate what Vance Packard called “hidden persuaders,” some of which can be quite clever and even impressive. For example, the FedEx logo. The company acronym contains a hidden symbol which one can glimpse with a little attention, namely, the white-space arrow implying forward motion between the concluding “E” and the lower case “x.”

The problem is, as we should all be aware, that phrases may also be used for nefarious purposes, insinuating themselves into the mind as signifiers for non-existent “realities” or as de facto claims that are wholly fraudulent. The names of many totalitarian dictatorships bear misnomers like “Democratic” or “Republic” or “Free,” which fool only the credulous and the partisan. Does an area of the Pacific Ocean belong to China because it is called the South China Sea?

But it is astonishing how many people fall for the appellative shell game, accepting without skepticism or critical thought the radiant energy of such — let’s call them — deceptors. They must mean what they say, especially by dint of incessant repetition. This, according to Goebbels, is how the “Big Lie” operates. I have conversed, much to my chagrin, with many otherwise sensible people who have swallowed the phrasal and lexical subterfuge hook, line and sinker.

In an article for PJ Media, “The Semantic Whoredom of the Left,” Sarah Hoyt unpacks such words for us — words, she explains, “that are in common use voided of their signification and filled with meanings they were never meant to have, meanings that can only be understood if you share the basic assumptions of leftist liberals.” We may regard them as semiotic false flags where connotations substitute for denotations, or as Hoyt writes, the Left is “holding perfectly good words captive and making them commit acts against their nature.” Regrettably, the gullible are routinely taken in.

A decapitated and burned animal carcass was recently discovered on the front porch of a Department of Homeland Security (DHS) official’s Washington, D.C. home, ABC Radio reported Monday.

The incident came amid an increase in threats against DHS employees, with some two dozen reported in the past few days. DHS sent a letter Saturday to all employees apprising them of the “heightened threat,” which appears to have been exacerbated by a broader national backlash against the Trump administration’s “zero tolerance” immigration-enforcement policy.

“This assessment is based on specific and credible threats that have been levied against certain DHS employees and a sharp increase in the overall number of general threats against DHS employees,” Claire Grady, acting deputy secretary of Homeland Security, wrote to employees on Saturday in a letter obtained by ABC.

Roughly 2,300 children had been separated from their parents since the Trump administration announced in May that it would prosecute everyone who crossed the border illegally. President Trump ostensibly ended family separations via executive order Wednesday and more than 500 children have reportedly been reunited with their parents since.

Our government’s first duty is to secure the border.

This weekend, Washington mourned the iconic Charles Krauthammer’s passing. It seemed a pause in the bedlam on the border, about which he would surely have had something wise to say. As someone who knew Dr. K mainly through his scintillating columns and television commentary, I suspect his thoughts on the refugee tide would be shorn of hubris about what Washington’s laws can accomplish.

The futility of dictating to the tide, rather than shoring up against it, was an occasional Krauthammer theme. He was wont to invoke an apocryphal tale about Canute the Great (see, e.g., here), who ruled a North Sea empire a millennium ago. In this, as in innumerable other ways, Charles was singular among commentators because he got the story right. His throne moved to the coastline, Canute audaciously orders the incoming tide to halt. But this is not a cautionary tale about the delusional arrogance of power. It is about humility: The king was showing his sycophantic courtiers that the law — in this instance, the writ of a purportedly omnipotent monarch — is limited, sometimes impotent, against such phenomena as the forces of nature.

The “rule of law” is not a magic wand. It is possible only in a community that has agreed to live under its provisions. Even within such a community, it must enforced by the power of the state. Law enforcement is manageable as long its resources are commensurate with the reasonably expected degree of law-breaking.

“Why the hell are we standing down?”

That was the question that the White House’s cybersecurity coordinator was asked after Susan Rice, Obama’s national security adviser, issued a stand down order on Russia.

Testimony at the Senate Intelligence Committee hearings on Russian interference in the election once again raised the central paradox of the Russia conspiracy theory. If Russian interference in the election represented the crisis that we are told it did, why did Obama fail to take any meaningful action?

The White House’s own cybersecurity people wanted an aggressive response before being told to stand down. Obama issued a bloodless warning to Russia while his people deliberately crippled our offense.

Democrats and the media blamed the Russian hacking on Trump. But it was Susan Rice who had told the cybersecurity team to “knock it off” and Obama’s people who hadn’t wanted him to be “boxed in” and forced to respond to Russian actions. Was this just the usual appeasement or was there more to it?

Why didn’t Obama and his team want to stop Russian hacking? Because they needed the Russians.

A month from now there will be a new manufactured news story that Donald Trump is savage, represents an existential danger, or is unhinged. We will hear of another Trump official cornered and driven out from a liberal-owned Beltway or New York City restaurant. An unhinged Rep. Maxine Waters (D-Calif.) will rant some more about impeachment.

And then the current hysteria over the border detainments will be filed, and go the way of the “s—hole countries” frenzy or Melania’s jacket melodrama.

We’ve already been through the dizzying odyssey of legal suits in three states over supposedly fraudulent voting machines, the nullification of the Electoral College effort, the meltdown on Inauguration Day, the Emoluments Clause tizzy, the 25th Amendment con, the various Russian collusion hysterias, the leaked phone call to the Australian prime minister, the Michael Wolff Fire and Furyfantasies, the Dudley Do-Right James Comey pre-indictment book tour, and all the surreal assassination chic stories, from Kathy Griffin’s beheading photo to the Shakespearean troupe’s ritual stabbing of Trump.

One day the president is supposedly going to blow up the world by calling Kim Jong-un “little rocket man,” and the next he is a partner in genocide for not blowing up the world but reaching out to Kim.

One moment Trump will tank the economy and wreck the stock market, the next the undeniable Trump boom is not really his own but Obama’s. Give the media credit: it found a way to explain why 3.8 official unemployment and greater than 3 percent GDP growth is a bad thing (it will heat up the planet, lead to a crash, mask Trump’s crudity and make impossible impeachment, etc.)

Hillary Clinton lost the Presidency in 2016 for many reasons but one was surely because she called people who disagreed with her a “basket of deplorables.” Millions of Americans knew who she meant, and nearly 63 million voted for Donald J. Trump.

The political left is now repeating that mistake as its cultural and political vanguard sends a message of condescension, hostility and now ostracism to anyone who voted for Mr. Trump or has worked with or for him for the good of the country. Their relentless contempt might end up re-electing him.

On that score don’t underestimate how the refusal by a restaurant in Lexington, Virginia, to serve White House press secretary Sarah Huckabee Sanders will resonate politically. Ms. Sanders had taken a seat at the Red Hen with several others on Friday when owner Stephanie Wilkinson asked her to leave. Ms. Wilkinson told the press, which is turning her into Rosa Parks, that her restaurant “has certain standards that I feel it has to uphold, such as honesty, and compassion, and cooperation.”

Except toward people who don’t share Ms. Wilkinson’s views. Rest assured every Trump supporter in America will be reminded of this episode from here to November. The message: Now you’re so deplorable they won’t serve you in their restaurants.

Meanwhile, hecklers ran Secretary of Homeland Security Kirstjen Nielsen out of a Mexican restaurant in Washington, D.C. last week. Protesters are also harassing Ms. Nielsen at home, blaring audio of crying children detained at the border and shouting “no justice, no sleep.”

Key positions throughout the federal government remain vacant more than 500 days into Donald Trump’s Presidency. The President hasn’t put forward enough nominees, a mistake the media have focused on. Yet Senate Democrats—and the occasional Republican—have held up qualified nominees at a scale unprecedented in recent history.

No one understands this better than Brian Benczkowski, who was nominated more than a year ago to lead the Justice Department’s Criminal Division. Mr. Benczkowski is a highly qualified choice for Assistant Attorney General: He has held five leadership positions at Justice, including chief of staff to former Attorney General Michael Mukasey. Obama and Clinton appointees have praised his selection, yet Senate Democrats have treated Mr. Benczkowski as if he were Vladimir Putin’s personal attorney.

Senate Judiciary Committee Democrats sent a letter to President Trump in May—11 months after receiving the nomination—regarding the nominee’s “Russian connections.” They urged the president to drop Mr. Benczkowski over his “representation of the Putin-allied Alfa Bank and his refusal to recuse himself from Russia-related matters.”
