JAN MEL POLLER: OBAMACARE IS NOW THE LAW OF THE LAND…WHAT ABOUT ALL THE OTHER LAWS OF THE LAND?

The Affordable Health Care Act (“Obamacare”) is now the law of the land and we are told that as such it must be obeyed.  What about all the other laws of the land?

 

President Obama, like all other Presidents took the oath of office (video) as written in the Constitution:

 “I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

 

The Oath of Office does not require the President to obey the Constitution.  The President is free to do whatever he wants.  As the “Most Transparent Administration in History”, we should look at what is being done.

 

 

The Supreme Law of the land is the Constitution.  What isn’t being obeyed?  (Note: all spelling is as written in the original document.)

 

 

Article. I.

 

Section. 8.

 

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

 

 

The Supreme Court ruled that Obamacare is a tax.  It is not uniform throughout the states.

 

 

Article. IV.

 

Section. 2.

 

 

The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.

 

 

This is obviously not the case with Obamacare where some states, like Nebraska, received special privileges,

 

 

Amendment I

 

Freedoms, Petitions, Assembly

 

 

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

 

 

The Executive Branch has infringed on the rights of Conservatives to have mot-for-profit organizations regardless of the Constitution or Laws.

 

 

Amendment IV

 

Search and arrest

 

 

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

 

 

We are not secure in our communications when specific warrants aren’t issued and national security is not the issue.

 

 

It appears that the President is not bound to obey the Constitution and indeed does not.  He has declared Obamacare to be the Law of the Land and as such, it must be obeyed.

 

 

Immigration and Citizenship are laws of the Land but are not obeyed.  We have Sanctuary Cities where people in the country are illegally protected by city governments.  The Federal Government will do nothing to stop this.

 

 

Under Obamacare, if you are a legal citizen of the United States, you pay for health care.  If you can’t show citizenship, then you receive free health care.

 

 

Drugs such as marijuana and heroin are illegal.  The Federal Government has made the decision not to persecute states who are violating the law by making marijuana legal.

 

 

We do not have Rule of law.  We have Rule of Obama. It sets a precedent for future presidents.

 

 

There are ways to remedy this situation:

 

 

1.       Amend the oath of office in the constitution so that it reads:

 

 

“I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, obey, preserve, protect and defend the Constitution of the United States.”

 

2.       Obamacare Law is unreadable with Amendment upon Amendment.  Require the final version of a law to be voted on to have all the Amendments be incorporated in a clear version.

 

3.       Require all proposed laws to be in the public domain for a month, except in cases of national emergency, giving citizens time to read the law and comment on it to their elected representatives.

 

4.       Remove all laws that are obsolete, or unenforceable.

 

5.       Simplify all laws that are not clear such as the IRS code and Obama Care.

 

6.       Make all executive orders and regulations subject to cancellation by congress.

 

 

 

Congress and citizens groups need to sue the government whenever the Constitution is disobeyed.
