ICE Deports Gang Member Wanted for Murder – Again

Today’s commentary is based on an article I recently wrote for the CAPS (Californians for Population Stabilization website). My CAPS article was, itself, prompted by a news release that was posted on May 24, 2012 by ICE (Immigration and Customs Enforcement) that touted the arrest and deportation of Tarsis Dodamin Quintero-Sanchez. Quintero-Sanchez is an illegal alien from El Salvador who previously had been deported from the United States on four occasions and is now wanted in his native El Salvador for his alleged role in a shooting death there nearly five years ago.

The fact that this violent thug could so easily illegally reenter the United States makes it clear that no matter how secure Ms. Napolitano, the Secretary of Homeland Security, claims our borders are, in point of fact, our borders are not at all secure enough. It would certainly seem that our border now acts as a huge revolving door, enabling illegal aliens and the criminals and terrorists among them, to return easily to the United States no matter how many times they may be deported.

Quintero-Sanchez, the illegal alien upon whose arrest and deportation the ICE news release was predicated, clearly posed a threat to the members of the community in which he lived while he managed to hide in plain sight. Even while hiding in the United States to evade capture and prosecution in his native El Salvador, he continued to commit crimes within the United States. Yet the head of DHS, an agency I have, for obvious reasons, come to refer to as the Department of Homeland Surrender, continues making public appearances claiming that our borders are secure. She has also claimed that “spillover violence” from Mexico is not a problem. For Ms. Napolitano, nothing about our porous borders or failures to enforce our immigration laws effectively is a problem.

Perhaps it could be said that for Ms. Napolitano, issues concerning immigration law enforcement and border security are matters of mind over matter – if she doesn’t mind these failures, then it doesn’t matter!

The administration needs to go back to basics and read the Immigration and Nationality Act (INA).

Title 8, United States Code, Section 212, is contained within the Immigration and Nationality Act, and enumerates the various categories of aliens who are statutorily ineligible to enter the United States, and will provide a clear prospective as to the intention and extreme importance of our nation’s immigration laws. Among the categories of aliens who are supposed to be kept out of the United States are aliens with dangerous communicable diseases, aliens who suffer serious mental illness and are prone to violence, aliens who are convicted felons, aliens who fugitives from justice in other countries, aliens who are human traffickers and drug smugglers, aliens who are war criminals and aliens who have committed human rights violations. Also aliens who are engaged in terrorism and espionage are among those who are, by law, supposed to be prevented from entering our country.

It must therefore be presumed that aliens who seek to evade the inspections process that is mandated by our laws to protect our citizens and our country from aliens described in the section of law I noted above are members of one or more classes of excludible aliens. Furthermore, records of entry are not created when aliens are not inspected when they enter the United States, creating additional national security vulnerabilities.

What seems to be missing from most discussions about illegal immigration is the simple and fundamental fact that the purpose of our nation’s immigration laws is to protect American lives and protect American jobs.

Currently the entire immigration system lacks integrity and the many failures of the federal government to instill meaningful integrity into the enforcement and administration of our immigration laws creates a serious threat to national security.

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right – it is your obligation!

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are.We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

Lead, follow or get out of the way!
